MCA enables CPC for Corporate Filings | EZTax.in

Government authorised MCA to enable "Companies (Registration Offices and Fees) Amendment Rules, 2024" through a gazette notification, CG-DL-E-15022024-252091

To make doing business easier, the CPC (Central Processing Center), which is similar to the Income Tax Department, is taking care of commonly used MCA e-forms. In contrast to today's, regional offices spread across India.

This is a fabulous news for the entrepreneurs and founders of the LLPs and Companies. The initiative should lead to faster processing, like the D+1 (next day) time frame shown on the NSWS Portal.

In summary, the changes are as follows :

  1. The Central Processing Center (CPC) is allowed to handle 12 forms or applications starting on February 16, 2024. From April 1, 2024, they will handle other forms.
  2. As with the Central Registration Centre (CRC) and Centralised Processing for Accelerated Corporate Exit (C-PACE), the new plan is for the CPC to handle applications in a uniform and time-bound way.
  3. The change from the MCA is meant to make it easier for LLPs and Private Limited Companies to do business.

The following is a list of forms, documents, and/or applications that the CPC is expected to handle.

According to the table below, if an assessee files more than one form, the CPC will decide how to handle them if any of them are not listed.

8Application to ROC for obtaining the status of dormant company under sub-section (1) of section 455 of the Act in e-Form no. MSC-1
9Application for seeking status of active company under sub-section (5) of section 455 of the Act in e-Form no. MSC-4
10Letter of Offer under section 68 of the Act in form e-Form no. SH-8
11Declaration of Solvency under sub-section (6) section 68 of the Act in e-Form no. SH-9
12Return in respect of buy-back of Securities under sub-section 10 of section 68 of the Act in e-Form no. SH-11
